Terms & Conditions

Key Points:

  • No Refund can be given for non-operational rides, electrical power cuts, weather related closures (if Rainy Day Return policy hasn’t been activated) or any other situation beyond our control.
  • Wristbands are non-transferable, and are per person, per day.
  • The Management reserves the right to alter, withdraw or change the price of any advertised ride or facility without prior notice.
  • During low season rides may operate in rotation.
  • The Management also reserves the right to refuse admission to any person(s).
  • Tops and suitable footwear must be worn at all times
  • Smoking is not permitted at Brean Theme Park (except for the use of electronic ‘Vapes’)
  • The consumption of Alcohol is not permitted at any time at Brean Theme Park
  • The riding of Bicycles and Scooters is not permitted at Brean Theme Park
  • Dogs are permitted on Brean Theme Park, but must be kept on a lead at all times, and please ensure you clean up after your dog.
  • By entering Brean Theme Park you consent to being filmed or photographed, and the resulting images used for whatever purposes without reward to you.
  • Wristbands bought online are only valid for the specified date (and/or time) on your booking.
    Wristbands cannot be booked online for Blue days from 3pm. These will be cheaper purchased at the gate..
  • PLEASE NOTE, we do NOT accept personal cheques.
  • All prices include VAT.
  • Fun Card Credits expire at the end of each season. (Sunday 3rd November 2024)

COVID-19 Terms of visit
By purchasing wristbands (whether online, or on site) the visitor certifies that they are aware of and accept the following Terms & Conditions regarding COVID-19.
1.    The visitor accepts responsibility of the COVID related risks whilst visiting the attraction.
2.    The visitor agrees that they are not vulnerable nor do they have any underlying health issues.
3.    The visitor agrees that their hygiene and sanitisation is their own responsibility
4.    The visitor agrees to follow any current government guidelines 

Purchase of wristbands online and onsite:
The list of rides indicated for each type of wristband is subject to change, temporary closure or exclusion with no prior warning. The Management reserve the right to withdraw or alter any of the facilities, prices or advertised items, at any time without prior notice. Guests are also informed that rides and Brean Theme Park itself may be closed, temporarily withdrawn or otherwise unavailable at any time due to technical or operational reasons, power failure, capacity or inclement weather (if Rainy Day Return policy hasn’t been activated). All Wristbands are sold on the strict understanding that they are non-transferable, and are per person, per day. The Return visits of the 3 Day Pass must be used within 7 days of the first visit - ie. first visit on a Monday, return for two more visits from the next day until the following Monday (inclusive). If you wish to upgrade (or downgrade) the band - eg. from a junior to a mega, it can only be done on the day of your first visit. Once removed wristbands will become invalid. All wristbands are sold with the full understanding of usage and conditions. No refunds will be given for earlier than advertised closing for reasons such as inclement weather (if Rainy Day Return policy hasn’t been activated), power failure or any situation beyond the control of Brean Theme Park.

Wristbands do not include ‘Pay as you Play’ rides — Go-Karts, Congo Adventure Golf, Prize Game Zones, coin operated Children’s Rides.

Online Booking Terms & Conditions:
Customers purchasing online agree to the following: To redeem wristbands at the park, you must present confirmation of your purchase to the Cashier at the Pay Booth, clearly stating your booking number, along with your credit or debit card used for purchase. Wristbands selected are as indicated and stated on the final cart page. No other promotional offer or discount can be used in conjunction with online band sales. Total price indicated will be deducted from your chosen preferred debit or credit card. Wristbands are per person, per day and are not transferable. All wristbands booked online must be redeemed at the same time. Evening or after 3pm Wristband sessions cannot be booked online. Click here to see calendar for opening times.

By placing an order with us you will be deemed to have read, understood and agreed to these Terms and Conditions. If you are unhappy with any aspect of these, then you should contact one of our customer service advisors by emailing us at info@breanthemepark.co.uk before placing an order with us. These Terms and Conditions and your use of our web site are governed by English law and you agree to submit to the non-exclusive jurisdiction of the English court. This does not affect your non-excludable statutory rights. This website and our Terms and Conditions have been designed for use within the United Kingdom and under UK law. Whilst we are happy to consider requests for products and enquiries from outside the United Kingdom, we give no warranty, express or implied, that the use of this website or the placing of any order through this website from outside the UK complies with any applicable non-UK laws or regulations. Accordingly, any products or promotions not permitted under your local law are not offered to you. A Contract between the customer and Brean Theme Park for the sale of our products will only exist once an order has been accepted. This does not affect the customer’s statutory rights. Prices and availability of goods are subject to change without notice. Ride Height restrictions apply. Guests are admitted to the park subject to the park regulations which are displayed at the main entrances to the park.

BREAN THEME PARK IS PRIVATE PROPERTY. All persons wishing to ride any of the attractions at the Theme Park must hold a valid wristband or Fun Card. The sale of wristbands or Fun Card credits by anyone other than Brean Theme Park is strictly prohibited. Only persons authorised by us are permitted to sell or offer for sale any items to guests within the Brean Theme Park grounds. All wristbands/ Fun Card credits are non-transferable and not for resale. Wristbands may not be valid for special events which may attract a separate admission fee. Wristbands and Fun Card credits will only be exchanged or refunded if Brean Theme Park, in its absolute discretion, chooses to do so. For the avoidance of any doubt, pre-booked wristbands are non-refundable in the event that admission is refused or relinquished for any reason referred to in these conditions. If Wristbands/ Fun Card credits are bought on behalf of other guests, the buyer accepts these conditions on behalf of every guest and shall ensure that these terms and conditions are complied with by each person in the group. Wristbands and Fun Cards must be retained at all times and submitted for inspection if required by Brean Theme Park.

Payment and Taxes:
We accept online payment by credit/debit card in a secure environment provided by WorldPay Online Payments. We currently accept Visa, Mastercard, Delta and Maestro. All transactions are shown in £ sterling. All prices quoted on this website are accurate at the time of publication and are quoted in pounds sterling (£) and where appropriate are inclusive of VAT at the current rate. When you enter your credit card details if you look up at the URL of that page you will notice that it begins with https://. This means that it is on a Secure Server and all transactions that take place are encrypted between your browser and the server. Nobody is able to obtain your credit card details nor other information. Of equal importance is the security which surrounds the payment system. By making use of WorldPay we have the most sophisticated online trading system available. It allows us to safely process your credit card payment with the bank, and complete the financial transactions securely behind protected firewalls. No personal or financial details are left unencrypted on a remote server, and such details are never sent by internet email.

For onsite payments at the Pay Booths we accept cash and debit/credit cards (except American Express). Card payments are securely processed using WorldPay. We no longer accept Tesco Vouchers.

Group Booking Terms and Conditions
Group rates apply for parties of 10 or more people, and must be booked at least 7 days before your visit

Upon receipt of your booking form and deposit, we will issue a booking confirmation and invoice.

A booking is considered provisional until the balance of payment has been received, and funds cleared. This must be up to 7 days prior to your visit.

We strongly advise booking for the minimum number of people likely to visit, as no refund can be made for non-attendance. Any additions can be paid for on the day of the visit by credit/debit card, or cash.

Prices are valid until the end of the season (Sunday 3rd November 2024).

Groups must enter the park all together, wristbands will be fitted at either Park Information or at a Pay Booth.

Guests are reminded that for technical, operational, weather, or other reasons, any attraction, ride or facility may be closed, altered or be otherwise unavailable at any time without prior notice.

The responsibility for children at all times rests with the responsible adults accompanying the children.

Please note that minimum and maximum height restrictions apply on all rides. The Giant Wheel, Congo Adventure Golf, Go Karts and Prize Games are payable separately using our Fun Card or cash/card and are not covered by the wristband. Usual park terms and conditions apply.

Rainy Day Return Terms and Conditions
Offer is activated only at the discretion of Brean Theme Park, and is valid for wristband purchases only.
Free wristband is only valid for the next trading day after the initial visit.
Half Price Sunday return offer – half price based on original onsite prices.
Original wristband(s) and receipt must be shown.
 

School Booking Terms and Conditions
School rates apply for parties of 10 or more people, and must be booked at least 7 days before your visit.

Our commitment to provide a service:
We will endeavour to ensure that as many rides as possible are available for use by guests at Brean Theme Park. However, we reserve the right, without prior notice, to close and change the programme of rides and attractions and/or the operating hours.

Brean Theme Park in its absolute discretion reserves the right to close the whole or any part of the Park at any time or to restrict the number of persons having access to the Park. The reason for any closure or restriction provided by this condition may include technical or operational reasons, capacity, inclement weather, special events or to ensure the safety and security of guests, or if Brean Theme Park Ltd reasonably considers the circumstances so require.

All rides, attractions, amusements, and any other facilities located at Brean Theme Park must only be used in accordance with the relevant manufacturer’s or operator’s instructions which include restrictions in relation to users’ height, weight and size.

You are admitted to the Brean Theme Park subject to the following terms and conditions. If you do not comply with them you may be removed from the Brean Theme Park by its personnel, security or police officers, without any right to a refund.

This is without prejudice to any claim that we may have against you or arising out of your actions. Whilst inside Brean Theme Park, you must comply with any reasonable instructions given to you by our personnel or any third party instructed on our behalf.

Brean Theme Park reserves the right to vary these terms at any time without prior notice. By entering Brean Theme Park, you accept that you have a duty to take reasonable steps to ensure your own safety, taking into account any personal medical conditions. All persons in and around Brean Theme Park should behave in a safe manner at all times.

General Terms:
For health and safety reasons, wheelchairs and mobility scooters are the only transport devices permitted within Brean Theme Park. For the avoidance of doubt, scooters, bicycles, roller skates, skateboards, trikes, 'Heeleys' and/or any similar devices are not permitted to be ridden within Brean Theme Park.

Our right to remove you:
Brean Theme Park, acting reasonably at all times, reserves the right, to refuse admission to the Park, ban from entry to the Park, or remove from the Park without any right to a refund any person whose presence or behaviour may affect the enjoyment and/or safety of other guests or staff or who: acts in an inappropriate and/or undesirable manner whilst travelling to the Brean Theme Park whether by bus, coach or other means, where such behaviour has been reported to us by a reliable independent source; or uses violent, aggressive, threatening, abusive, discriminatory or insulting words or behaviour or in any way behaves in a manner which may provoke a breach of the peace; climbs or stands upon fences, barriers, walls, safety fences, rock arrangements, ride structures, exhibits or any other buildings at Brean Theme Park; enters or attempts to enter any part of Brean Theme Park which is a restricted or prohibited area as determined by Brean Theme Park including, ride areas, workshops and staff areas without the express permission of Brean Theme Park. We reserve the right to initiate legal proceedings or prosecute any person who: is found damaging or defacing any part of the grounds, fences, barriers, walls, ride structures, exhibits, fabrics or buildings at Brean Theme Park; or has displayed any sign or visible representation of any kind which is, or could be reasonably judged to be, threatening, abusive or insulting; or has previously acted in any manner which has caused any person to report that individual to Brean Theme Park; or is attempting to regain admission to the rides without valid wristbands or Fun Card ; or Brean Theme Park reasonably believes that they have purchased wristbands or credits from an unauthorised source. If any guest in breach of any of these conditions is a member of a group, then such group of individuals may also, at Brean Theme Park’s discretion, be denied entry or escorted from the Brean Theme Park without any right to a refund.

Your behaviour:
Unnecessary noise or any behaviour likely to cause annoyance to other guests or confusion of any kind is not permitted in any part of the Park. Smoking is strictly prohibited within the park (excluding electronic cigarettes / vapes).

Brean Theme Park is committed to ensuring that all our employees are treated with dignity and respect. We will therefore not tolerate any form of violence or aggression by our guests which may affect our staff or the enjoyment of our other guests. Admission will be refused or the guest will be escorted from the Park without right to refund.
We will also not tolerate any form of aggression or any act or threat of violence to a member of our staff or guest at the Park. If such an incident should occur, steps will be taken to evict the person from the Park and if necessary the Police will be called.

Examples of threatening or violent behaviour include:

  • Intimidation such as shouting or swearing.
  • Threatening behaviour in the form of verbal threats, gestures and obstruction etc.
  • Possession of any weapon, regardless of the lack of any overt threat to use it.
  • Being incapable whilst under the influence of drink & / or drugs.
  • Any unwanted physical contact.
  • Personal insults.
  • Sexual or racial harassment

Your dress & appearance must be suitable for a family attraction:
You must wear appropriate clothing (including a top and shoes) at all times whilst at Brean Theme Park. If you are wearing clothing that is indecent or likely to cause offence in any way, you will be refused entry or removed from Brean Theme Park. Stilettos and loose clothing are not allowed on some rides due to health and safety reasons. Suitable footwear must be worn on all rides for your own safety, and socks must be worn on certain rides in the interest of hygiene.

Security:
To prevent offensive weapons or dangerous articles from being brought into the Brean Theme Park, you are admitted to the Brean Theme Park subject to the condition that, if requested to do so, you will allow yourself and/or your belongings to be searched. It is prohibited to bring into Brean Theme Park any weapons, fireworks, smoke bombs, glass bottles or other articles which may cause injury. The throwing of any article which could cause injury or affect the enjoyment of other guests is strictly prohibited. Any person found to be in possession of an article deemed to be offensive or dangerous will be immediately escorted from Brean Theme Park without any right to a refund and we reserve the right to make reports to the relevant authorities which may lead to prosecution. The consumption of intoxicating liquor is not permitted at Brean Theme Park. Any persons found possessing alcohol, or who appear to be under the influence of alcohol may be refused admission to Brean Theme Park or escorted from Brean Theme Park without any right to a refund. The use of illegal substances and/or legal highs (including, but not limited to, laughing gas) are strictly prohibited and any persons found possessing, using or who appear to be under the influence of illegal substances and/or legal highs will be refused admission or escorted from Brean Theme Park without any right to a refund. CCTV cameras are used to assist in the proper running of the Brean Theme Park. However, we do not make any representation as to the extent of coverage provided by the cameras. All items, belongings and other property brought into the Brean Theme Park by you are at your own risk and we accept no liability for any loss or damage to such property. As such, we recommend that you do not bring valuables to the Brean Theme Park.

Parking:
Please be advised that Brean Theme Park Ltd does not operate the two car parks available. They are managed by Smart Parking Ltd on behalf of Brean Leisure Park Ltd. Their helpline number is 0845 230 3081. Their terms and conditions, as displayed in the car parks, are set out below:

Smart Parking Ltd “the Creditor” (Company No: SC138255) manage and operate this car park. We are not responsible for the car park surface, damage or loss to or from motor vehicles or general site safety. Parking in this car park is subject to the Terms and Conditions that are set out within this notice (the “Parking Contract”). By parking or remaining in this car park you agree to the terms of Parking Contract (if you do not agree to them then please leave within 10 minutes of entry). Where you are in possession of a valid permit you agree to park in accordance with the terms set out within the permit. All permits must be registered or clearly displayed during your parking period (please see signage for additional details). If you do not have a valid permit and payment is required for parking, you agree to make payment in accordance with the tariffs set out on the signage throughout the car park. Where your vehicle registration is necessary for making payment for parking, you agree to enter your full and correct vehicle registration into the payment machine and make the appropriate payment upon entry or before removing your vehicle from the car park (as specified on the tariff signage). Where ANPR cameras are present on site, the parking time is calculated by the ANPR cameras from the point of entry to the point of exit. You also agree to park fully within the confines of a marked parking bay.
All vehicles parked within a designated disabled bay must display a valid Disabled Blue Badge in the windscreen of the vehicle at all times. Where disabled concessions apply, you agree to follow the instructions on the signage in order to qualify for the concession. Where Parent and Child bays are provided, you agree to comply with the terms specified on the signage. If you fail to comply with the conditions set out within this notice you accept liability to pay the Parking Charge Notice within 28 days for breaching the advertised Terms and Conditions of this site and thus breaching the Parking Contract (the ‘Parking Contract’).
This Parking Contract shall form the entire agreement between the parties. Any proposal to waive part of this Parking Contract shall not be valid unless it is confirmed in writing by Smart Parking Ltd.

By entering this car park you consent, for the purpose of car park management, to the capturing of photographs of the vehicle and registration by Automatic Number Plate Recognition cameras or by an attendant and to the processing of this data, together with any other data provided by you or others via any means whatsoever to check compliance with the Parking Contract and assist enforcement of any aspect of it. Where a parking charge becomes due a notice may be affixed to the vehicle or sent to the registered keeper by post. You understand that for Parking Charge Notices affixed to the vehicle, the registered keepers’ details may be requested from the DVLA where the Parking Contract is not adhered to for the purpose of issuing the charge to the registered keeper. You also understand that registered keeper details will be immediately requested from the DVLA for the purpose of issuing a
Parking Charge Notice generated using the ANPR camera evidence.
Personal data may also be shared with our trade association, appeals service and other organisations required to enforce payment of the charge. Failure to pay the charge may incur further costs which you agree to pay on an indemnity basis. An administration charge may apply where payment is made
by credit card.

This car park is private property. Having entered into this car park, do not park, wait or otherwise remain, unless you agree to these terms and conditions.

Pets:
Well behaved animals, on leads, are permitted at Brean Theme Park. For the avoidance of doubt, no animals should be left unattended in any vehicle parked at the Brean Theme Park. We reserve the right to contact any relevant authority to make and be responsible for any decision in relation to any animals that are left unsupervised or that are found to be in distress.

Photography:
Unless it is expressly prohibited, you are permitted to take photographs and recordings within the Brean Theme Park grounds (but not on the rides) provided that these are solely for private use and are not sold or used for any commercial or public purpose. For your safety you are prohibited from taking photographs and/or recordings whilst on any ride. 

However, If you are a broadcast channel or production house and would like to make an enquiry please email us and let us know your name, the show you’re working on and when it will air, when you would like to film and which ride(s) you would like to film on. We are happy to consider all filming and photography enquiries, and each request will be looked at on an individual basis.

  • Filming and photography requests can be accommodated between March and November when the Park is open - however during busy periods, requests will be judged on how they will affect the operation of the Park.
  • We are happy to consider requests to film on-board our rides but require at least 12 working days to arrange this. While we will endeavour to accommodate as many requests as possible, approval of on-board filming is subject to the Park’s Health & Safety procedures. Please note on ride filming must take place outside of the Park’s operating hours. 
  • On-board filming is subject to a pre-site visit with a member of the Management Team, and submission of your public liability insurance, risk assessment and camera use method statement.

By accepting these terms and conditions, you acknowledge that Brean Theme Park may on demand have access to photographs taken and video footage captured by you and request that certain photographs and/or footage are deleted if they are deemed to be offensive to, or infringe the privacy of, other guests and/or staff. By accepting these terms and conditions, you agree not to intentionally photograph and/or capture video footage of any individual without that person’s permission and you must adhere to all photography/filming restrictions in place from time to time whilst within Brean Theme Park. From time to time Brean Theme Park or other authorised parties carry out photography and/or video recording in the Brean Theme Park, which may feature guests. Entry to the Brean Theme Park is deemed acceptance of these terms and conditions, and you therefore agree that Brean Theme Park or any authorised party may use such images in perpetuity in any promotional, advertising or publicity material in any format whatsoever. You further agree that copyright in these materials rests with Brean Theme Park or such authorised party (as the case may be).

Our Liability
Brean Theme Park Ltd accepts no responsibility for any loss and/or damage suffered by you as a result of any event outside our control (including any distress, inconvenience, anxiety or loss of enjoyment arising from the evacuation of the Brean Theme Park). This does not affect your statutory rights.
